An unregistered assault rifle was found at the home of a Milford man after he allegedly shot at a squirrel -- although not with the assault rifle.
Police said they found the assault rifle along with three large-capacity magazines after a gunshot was overheard in a Milford neighborhood by officers directing traffic.
The New Haven Register reported that James Toigo, 65, was charged with unlawful discharge of a firearm, cruelty to an animal, reckless endangerment, second-degree breach of peace, failure to register an assault rifle, and three counts of possessing large-capacity magazines.
Toigo was taken into custody after police said he shot the squirrel.
Milford Officer Jeffrey Nielsen said the assault rifle was not used in the shooting, and that officers seized several firearms from the home for "safe keeping." Police believe the majority of the seized firearms are registered, The Register reported. To get his guns back, Toigo may need to petition the police department.
Toigo was released, and is due back in court May 13. It was not known by Thursday morning whether he has legal representation.
